Delegate McGeehan moved to amend the bill by striking out the title and substituting therefor a new title, to read as follows:

 

H. B. 2634 -- “A BILL to amend and reenact §61-8B-5, §61-8B-9, §61-8D-5 and §61-8D-6  of the Code of West Virginia, 1931, as amended, relating to increasing penalties and fines for sexual assault in the third degree; relating to increasing penalties and fines for sexual abuse in the third degree, relating to increasing penalties and fines for commission by a parent, guardian, custodian or other person in a position of trust in relation to a child under his or her care to engage in sexual exploitation of, or in sexual intercourse, sexual intrusion or sexual contact with a child under his or her care, custody, or control; relating to relating to increasing penalties and fines for the commission by a parent, guardian, custodian or other person in a position of trust in relation to a child under his or her care to knowingly procure, authorize, or induce another person to engage in sexual exploitation of, or in sexual intercourse, sexual intrusion or sexual contact with a child under his or her care, custody, or control upon a child under the age of 16 or any age if the child is disabled as defined in §61-8F-2 of this code, establishing the crime of attempt by a parent, guardian, custodian or other person in a position of trust in relation to a child under his or her care to knowingly procure, authorize, or induce another person to engage in sexual exploitation of, or in sexual intercourse, sexual intrusion or sexual contact with a child under his or her care, custody, or control upon a child under the age of 16 or any age if the child is disabled as defined in §61-8F-2 of this code and establishing fines and penalties,  increasing penalties and fines for commission by a parent, guardian, custodian or other person in a position of trust in relation to a child under his or her care to knowingly procure, authorize, or induce another person to engage in sexual exploitation of, or in sexual intercourse, sexual intrusion or sexual contact with a child under his or her care, custody, or control upon a child over the age of 16, establishing the crime of attempt by a parent, guardian, custodian or other person in a position of trust in relation to a child under his or her care to knowingly procure, authorize, or induce another person to engage in sexual exploitation of, or in sexual intercourse, sexual intrusion or sexual contact with a child under his or her care, custody, or control upon a child over the age of 16 and establishing fines and penalties; and relating to expanding the scope of persons subject to this section to include a person in position of trust, and increasing penalties and fines for sending, distributing, exhibiting, possessing, displaying or transporting material by a parent, guardian, or custodian, or person in a position of trust, depicting a child engaged in sexually explicit conduct”;
